Massage King is committed to privacy and security for all of our clients. Because we respect your right to privacy, we have developed a Privacy Statement as indicated below.

Personal Information

Under no circumstances do we transfer your email address to any other company, nor do we collect any personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs.

Effective date of this Privacy Policy: January 20, 2022 and shall continue until this document is updated or revised. MassageKing.com reserves the right to modify this document without notice. We've tried to make this privacy policy very informative. Yes, we know it's lengthy. In short, our policy is generally the same as most other generally accept privacy policies from the majority of ecommerce websites. There are two ways you can provide us with and consent to our collection of certain personal information:

E-mail Request - Links throughout our site provide you with the opportunity to contact us via e-mail to ask questions, request information and materials, or provide comments and suggestions. You may also be offered the opportunity to have one of our Sales Representatives contact you personally to provide additional information about our products or services. To do so, we may request additional personal information from you, such as your name and telephone number, to help us satisfy your request.

Enrollment - You may choose to purchase one of our products or services where we will request certain information from you. Depending on the type of product or service that you request, you may be asked to provide different personal information. For certain products and services, we may require your name, address, telephone number, e-mail address, and credit card number. Other products and services may require different or supplemental information from you in order to apply. By purchasing from, or registering an account with, MassageKing.com, you accept and agree to our Data Collection policies. 

Statistical Information About Your Visit

We assign site visitors "hashed" information that includes visitor ID's that enable us to monitor site use but does not personally identify you but rather records information about a visit to our site. However, once you have created and account, or started and/or completed the checkout process, that process does give us personally identifiable information, as is necessary for ecommerce. We may monitor statistics such as how many people visit our site, which pages people visit, and which browsers people use. We use these statistics about your visit to help us improve the performance of our web site and over all user experience.

Your Ability to Opt-Out of Further Notifications

YOUR INFORMATION STAYS WITH US

No customer information is ever given to a third party except in the normal process of fulfilling your order. We NEVER give out credit card information, nor do we give out any other customer's information (phone numbers, addresses, items ordered, email addresses, etc.) over the phone or by any other means to anyone except in the event that the product a customer ordered is to be shipped from one of our vendors and not from our warehouse in Broussard, Louisiana. In that event, we only give out the shipping information and the order. Finally, we have never in the past nor will we in the future sell any of our customer's information to third party marketers or spammers.

Data Collection and Retention

Anonymous information:

We monitor site traffic for administrative purposes—for example, to ensure smooth site traffic flow or to assess what pages on our sites are visited the most and by visitors from which countries and Internet Service Provider (ISP) domains, in addition to the keywords used to access our site. We do this by aggregating the anonymous information that your browser automatically transmits anytime you are on the Web.

Massage King does use tracking tools, such as Google Analytics, to help analyze how users use our website in order to provide a better overall experience. The tool uses "cookies," which are text files placed on your computer, to collect standard Internet log information and visitor behavior information in an anonymous form. The information generated by the cookie about your use of our website (including IP address) is transmitted to the tracking tool. This information is then used to evaluate visitors' use of the website and to compile statistical reports on website activity.

The tracking tool will not associate your IP address with any other data held by us. We do not associate any data gathered from this site with any Personally Identifiable Information from any source, unless you explicitly submit that information via a fill-in form on our website.

We also may implement features based on Display Advertising (Remarketing with Google Analytics, Google Display Network Impression Reporting, DoubleClick Campaign Manager integration, and Google Analytics Demographics and Interest Reporting). Third-party vendors, including Google, show our ads on sites across the Internet, and we want to do our best to make sure we are showing them to people who are actually interested in them. We, along with third-party vendors, including Google, use first-party cookies (such as the Google Analytics cookies) and third-party cookies (such as the DoubleClick cookie) together to report how your ad impressions, other uses of ad services, and interactions with these ad impressions and ad services are related to visits to our website.

Legal Obligations

Business Transfers

Data that is Not Personal Data

Tracking Tools, Advertising and Opt-Out

The Services use cookies and similar technologies such as pixel tags, web beacons, clear GIFs, and JavaScript (collectively, “Cookies”) to enable our servers to recognize your web browser, tell us how and when you visit and use our Services, analyze trends, learn about our user base, and operate and improve our Services. Data Security and Retention

We seek to protect your Personal Data from unauthorized access, use, and disclosure using appropriate physical, technical, organizational, and administrative security measures based on the type of Personal Data and how we are processing that data. Although we work to protect the security of your data that we hold in our records, please be aware that no method of transmitting data over the internet or storing data is completely secure.

We retain Personal Data about you for as long as necessary to provide you with our Services. In some cases we retain Personal Data for longer, if doing so is necessary to comply with our legal obligations, resolve disputes, or collect fees owed, or is otherwise permitted or required by applicable law, rule, or regulation. We may further retain information in an anonymous or aggregated form where that information would not identify you personally.

Personal Data of Children

As noted in the Terms of Use, we do not knowingly collect or solicit Personal Data about children under 16 years of age; if you are a child under the age of 16, please do not attempt to register for or otherwise use the Services or send us any Personal Data. If we learn we have collected Personal Data from a child under 16 years of age, we will delete that information as quickly as possible. Access

You have the right to request certain information about our collection and use of your Personal Data over the past 12 months. In response, we will provide you with the following information:

  • The business or commercial purpose for collecting or selling your Personal Data.
  • The categories of third parties with whom we have shared your Personal Data.

If we have disclosed your Personal Data to any third parties for a business purpose over the past 12 months, we will identify the categories of Personal Data shared with each category of third party recipient. If we have sold your Personal Data over the past 12 months, we will identify the categories of Personal Data sold to each category of third party recipient.

Deletion

You have the right to request that we delete the Personal Data that we have collected about you. Under the CCPA, this right is subject to certain exceptions: for example, we may need to retain your Personal Data to provide you with the Services or complete a transaction or other action you have requested. If your deletion request is subject to one of these exceptions, we may deny your deletion request.

Exercising Your Rights

To exercise the rights described above, you or your Authorized Agent (defined below) must send us a request that (1) provides sufficient information to allow us to verify that you are the person about whom we have collected Personal Data; and (2) describes your request in sufficient detail to allow us to understand, evaluate, and respond to it. Each request that meets both of these criteria will be considered a “Valid Request.” We may not respond to requests that do not meet these criteria. We will only use Personal Data provided in a Valid Request to verify your identity and complete your request. You do not need an account to submit a Valid Request.

We will work to respond to your Valid Request within 45 days of receipt. We will not charge you a fee for making a Valid Request unless your Valid Request(s) is excessive, repetitive, or manifestly unfounded. If we determine that your Valid Request warrants a fee, we will notify you of the fee and explain that decision before completing your request.

Personal Data Sales Opt-Out and Opt-In

We will not sell your Personal Data, and have not done so over the last 12 months. To our knowledge, we do not sell the Personal Data of minors under 16 years of age.

We Will Not Discriminate Against You for Exercising Your Rights Under the CCPA

We will not discriminate against you for exercising your rights under the CCPA. We will not deny you our goods or services, charge you different prices or rates, or provide you a lower quality of goods and services if you exercise your rights under the CCPA. However, we may offer different tiers of our Services as allowed by applicable data privacy laws (including the CCPA) with varying prices, rates, or levels of quality of the goods or services you receive related to the value of Personal Data that we receive from you.

Other State Law Privacy Rights

California Resident Rights Under California Civil Code Sections 1798.83-1798.84, California residents are entitled to contact us to prevent disclosure of Personal Data to third parties for such third parties’ direct marketing purposes; in order to submit such a request, please contact us at sales@massageking.com.

Nevada Resident Rights If you are a resident of Nevada, you have the right to opt-out of the sale of certain Personal Data to third parties who intend to license or sell that Personal Data. You can exercise this right by contacting us at sales@massageking.com with the subject line “Nevada Do Not Sell Request” and providing us with your name. Please note that we do not currently sell your Personal Data as sales are defined in Nevada Revised Statutes Chapter 603A.

European Union Data Subject Rights

The website for MassageKing.com is not set up to, and does not knowingly, accept orders from locations within the EU, or those covered by the GDPR.

EU Residents If you are a resident of the European Union (“EU”), United Kingdom, Lichtenstein, Norway, or Iceland, you may have additional rights under the EU General Data Protection Regulation (the “GDPR”) with respect to your Personal Data, as outlined below.

For this section, we use the terms “Personal Data” and “processing” as they are defined in the GDPR, but “Personal Data” generally means information that can be used to individually identify a person, and “processing” generally covers actions that can be performed in connection with data such as collection, use, storage, and disclosure. We will only process your Personal Data if we have a lawful basis for doing so. Lawful bases for processing include consent, contractual necessity and our “legitimate interests” or the legitimate interest of others, as further described below.

  • Contractual Necessity: We process the following categories of Personal Data as a matter of “contractual necessity”, meaning that we need to process the data to perform under our Terms of Use with you, which enables us to provide you with the Services. When we process data due to contractual necessity, failure to provide such Personal Data will result in your inability to use some or all portions of the Services that require such data.
    • We will process your shipping and billing information to fulfill an order you place with us.
  • Legitimate Interest: We process the following categories of Personal Data when we believe it furthers the legitimate interest of us or third parties:

Please note that in some circumstances, we may not be able to fully comply with your request, such as if it is frivolous or extremely impractical, if it jeopardizes the rights of others, or if it is not required by law, but in those circumstances, we will still respond to notify you of such a decision. In some cases, we may also need you to provide us with additional information, which may include Personal Data, if necessary to verify your identity and the nature of your request.

  • Access: You can request more information about the Personal Data we hold about you and request a copy of such Personal Data.
  • Rectification: If you believe that any Personal Data we are holding about you is incorrect or incomplete, you can request that we correct or supplement such data. Erasure: You can request that we erase some or all of your Personal Data from our systems.
  • Withdrawal of Consent: If we are processing your Personal Data based on your consent (as indicated at the time of collection of such data), you have the right to withdraw your consent at any time.     The Services are hosted and operated in the United States (“U.S.”) through Massage King and its service providers, and if you do not reside in the U.S., laws in the U.S. may differ from the laws where you reside. By using the Services, you acknowledge that any Personal Data about you, regardless of whether provided by you or obtained from a third party, is being provided to Massage King in the U.S. and will be hosted on U.S. servers, and you authorize Massage King to transfer, store, and process your information to and in the U.S., and possibly other countries.     We are constantly trying to improve our Services, so we may need to change this Privacy Policy from time to time, but we will alert you to any such changes by placing a notice on the Massage King website, by sending you an email and/or by some other means. Please note that if you have opted not to receive legal notice emails from us (or you have not provided us with your email address), those legal notices will still govern your use of the Services, and you are still responsible for reading and understanding them. If you use the Services after any changes to the Privacy Policy have been posted, that means you agree to all of the changes. Since we do not market to or knowingly accept orders from or shipping to locations located inside the European Union or those places covered by the GDPR, we do not have a European Union-based representative.

Visitors can opt-out of Google Analytics for Display Advertising and customize Google Display Network ads using Google's Ads Preferences Manager. You also can opt-out of Google Analytics by using Google Analytics' Opt-out Browser Add-on tool. Massage King also may use the Google AdWords remarketing service to advertise on third party websites (including Google) to previous visitors to our site. It could mean that we advertise to previous visitors who haven’t completed a task on our site, for example using the contact form to make an inquiry. This could be in the form of an advertisement on the Google search results page, or a site in the Google Display Network. Third-party vendors, including Google, use cookies to serve ads based on someone’s past visits to this website. Any data collected will be used in accordance with our own privacy policy and Google’s privacy policy.

You can set preferences for how Google advertises to you using the Google Ads Settings page, and if you want to you can opt out of interest-based advertising entirely by modifying your cookie settings, visiting the Network Advertising Initiative opt-out page, or permanently using a browser plugin.

GDPR

Due to the requirements of the GDPR and the amount of extra work it would take to comply, we have chosen to decline all sales and stop any and all marketing and efforts to people who reside in the GDPR member countries. To be honest, it's just too much work when you consider that most, not all, of the requests we get from people within the GDPR are for shipping quotes, which take a lot of work, only to have those people decide not to make a purchase because the shipping is usually so expensive. It's a lot of extra work that yields no significant benefit. We have disabled the ability to make any purchases for people in the GDPR respective countries. And we have removed any email addresses for people residing in those countries.
